The protection of your personal data is very important to us. With this privacy policy we inform you, the “user”, about the nature, scope and purpose of the collection, processing and use of personal data by the “operator” - Guenther Bionics GmbH, Wiesenweg 1, 39317 Parey – of this website.

The use of our website is generally possible without providing personal information. Insofar as personal data, such as name, address or e-mail addresses, are collected on our pages, this is always done, to the extent possible, on a voluntary basis.

Contact

While contacting our company by phone, fax, email, contact form or suggestions form, personal information may be stored for the purpose of processing the request and to facilitate follow-up as needed. Furthermore, personal data of the user from the contact are used for the execution of our service delivery and user requests. These personal data will be deleted if they are no longer required to fulfill contract's purposes, provided that no legal retention requirements preclude the cancellation (EU DSGVO, Art. 6, para. 1) and no voluntary consent to data storage has been given.

When contacting us, please be careful not to send us, if possible, any health data and other special categories of personal information that are not needed to fulfill your request. In this regard, we refer to the section “Health data and other special categories of personal data later in this privacy policy.

Furthermore, no one under the age of 16 may provide us with personal data without the consent of the legal guardian at the time of contact. A subsequent approval of the parent or guardian is not sufficient.

Registration function

Users can use the Customer Area to purchase products / services and downloads. This requires the application for a customer account that will be created for the user after careful verification and for which the access data are transmitted. The data to be provided by the user during registration is used for the purpose of using the online platform. Upon termination of the user account, the specified account data will be deleted, subject to the data for which the retention is necessary for commercial and tax reasons (EU-GDPR, Art. 6, para. 1). The irretrievable deletion of the data stored over the duration of the contract is by our authority. The data backup is the responsibility of the user.

Orders via user accounts

To be able to place orders via the online shop, you as the customer must set up a password-protected customer account. This contains an overview of the active order processes and the orders made. If you leave the online shop as a customer, you will be logged out automatically.

We as the operator assume no liability for the misuse of passwords, unless this was demonstrably caused by us as the operator.

Order process

All data entered by the customer as part of an order processing is stored. These data genrally include:

-          Name

-          mailing address

-          E-mail address

Data, which are absolutely necessary for the delivery or processing of an order, may be passed on to service providers, so-called “third parties”, for fulfillment for contract purposes. If your data is not earmarked for order processing, it is deleted, unless storage is mandated for commercial and tax reasons (EU DSGVO, Art. 6, para. 1), or we obtained voluntary consent from you.

Information on data processing

We only collect, process and use personal data of users in compliance with the relevant data protection regulations. This means that users' data will only be used if a legal permit or voluntary consent is available. The processing and use of your personal data takes place to fulfill and process your orders and to process your requests. After completion of the contract, all personal data are first stored under consideration of tax and commercial retention periods and then deleted after the deadline, unless you have consented to the further processing and use by a voluntary consent.

We take state-of-the-art organizational, contractual and technical security measures to ensure that provisions of data protection laws are complied with and in order to protect the data we manage against accidental or intentional manipulation, loss, destruction or access by unauthorized persons.

Disclosure of data

Generally, there is no unauthorized disclosure of personal data to third parties, unless it is necessary for the performance of the contract, corresponds to the interests of the person concerned or there is a higher statutory obligation.

To fulfill the legitimate interests (DSGVO, Art. 6, para. 1), personal data is processed by means of a software-supported merchandise management system. Among other things, service optimizations will be carried out for users in order to be able to perform the desired services as quickly as possible and to avoid additional expenses due to redundant data collection. If the interest of the user in the protection of his data outweighs the legitimate interests, we ask to contact us, and we point you to your rights (User Rights and Deletion of Data), which are explained later in this Privacy Policy.

For contract purposes, the transfer of address data of the user to a logistics service is necessary and justified to enable deliveries.

Health data and other special categories of personal data

To fulfill the contract for some services or jobs (fulfillment of the legitimate interests (DSGVO, Art. 6, para. 1)), information is needed, which may be pertinent to health data or other special categories of data. In this regard, we expressly ask for your voluntary consent to data processing. We obtain this consent separately. You can revoke your consent at any time. The revocation of consent does not affect the legality of the processing carried out on the basis of the consent until the revocation.

Other integration of services and content of third parties

It may happen that content from third parties, such as videos from YouTube, maps from Google Maps or graphics from other websites are included in this online platform. This always presupposes that the providers of this content (hereinafter "third-party") know the IP address of the user. The reason for this is that without the IP address, the content cannot be sent to the browser of the respective user. The IP address is therefore required for the presentation of this content. We endeavor to use only content whose respective providers use the IP address solely for the delivery of the content. However, we have no influence on whether third party providers store the IP address (e.g., for statistical purposes). If we are aware of this, we will inform users about it.

External links

Our online platform contains links to the websites of third parties. We point out that we have no influence on the content and design of these websites of external providers in external links. This privacy policy does not apply in this respect. The Guenther Bionics GmbH declares hereby expressly that at the time of the link setting no illegal contents were recognizable on the sites to be linked.

Social networks

It may happen that links and content references from social media such as Facebook or Twitter are integrated within our online platform. These social networks are operated exclusively by third parties, some of which have their place of business outside the EU or the EEC. An adequate level of privacy protection acc. §§ 4b, 4c BDSG may therefore not exist. We endeavor to identify these by means of suitable information (e.g., logos). When you visit one of our websites, information may be stored in the form of so-called cookies on your computer.
